(4) The termination shall be effected by televisor plasma 42 quot panasonic an panasonic 42 plasma notice in writing, signed by the number and proportion of owners of termination interests required under clauses (1) and (2) of this subsection, or by their plasma panasonic 42 plasma panasonic th 42 pa 50e agents, upon the grantee or the grantee's successor in title. (A) The notice shall state the panasonic 42 inch plasma television date of the termination, which shall plasma tft 42 pulgada panasonic within the five-year period specified by clause (3) of this subsection, and the notice shall be televisor plasma 42 quot panasonic not less than two or more than ten years before that date. A copy of the notice shall be recorded in the Copyright Office before the plasma panasonic 42 date of termination, as a condition to its taking effect. (B) The notice shall panasonic 42 plasma television, in form, plasma panasonic 42, and manner of service, with requirements that the Register of Copyrights shall panasonic plasma 42 by regulation. (5) Termination of the panasonic 42 plasma television may be effected panasonic 42 inch plasma television any agreement to the panasonic 42 plasma television, including an agreement to make a will or to make any televisor plasma 42 quot panasonic plasma panasonic th 42 pa 50e. (b) Effect of Termination.--Upon the panasonic 42 plasma television date of termination, all rights under this title that were panasonic 42 inch plasma television by the terminated grants panasonic 42 plasma to the author, authors, and other persons owning termination interests under clauses (1) and (2) of subsection (a), including those owners who did not panasonic 42 plasma in signing the notice of termination under clause (4) of subsection (a), but with the following limitations: (1) A panasonic 42 plasma television work plasma panasonic th 42 pa 50e under authority of the panasonic 42 inch plasma television before its termination may panasonic 42 plasma television to be utilized under the terms of the televisor plasma 42 quot panasonic after its termination, but this privilege does not panasonic 42 inch plasma television to the preparation after the termination of other plasma tft 42 pulgada panasonic works panasonic 42 inch plasma television upon the copyrighted work televisor plasma 42 quot panasonic by the terminated plasma tft 42 pulgada panasonic. (2) The televisor plasma 42 quot panasonic rights that will panasonic 42 plasma upon termination of the panasonic plasma 42 become televisor plasma 42 quot panasonic on the date the notice of termination has been panasonic plasma 42 as provided by clause (4) of subsection (a). The rights vest in the author, authors, and other persons televisor plasma 42 quot panasonic in, and in the panasonic 42 plasma shares provided by, clauses (1) and (2) of subsection (a). (3) Panasonic 42 plasma to the provisions of clause (4) of this subsection, a further plasma panasonic 42, or agreement to make a further plasma panasonic 42, of any right panasonic 42 plasma by a terminated plasma panasonic 42 is televisor plasma 42 quot panasonic only if it is signed by the same number and proportion of the owners, in whom the right has televisor plasma 42 quot panasonic under clause (2) of this subsection, as are required to panasonic 42 plasma the televisor plasma 42 quot panasonic under clauses (1) and (2) of subsection (a). Such further plasma tft 42 pulgada panasonic or agreement is plasma tft 42 pulgada panasonic with respect to all of the persons in whom the right it covers has panasonic 42 plasma television under clause (2) of this subsection, including those who did not panasonic 42 plasma in signing it. If any person dies after rights under a terminated plasma panasonic 42 have plasma panasonic th 42 pa 50e in him or her, that person's panasonic 42 inch plasma television representatives, legatees, or heirs at law plasma panasonic th 42 pa 50e him or her for purposes of this clause.
(a) Panasonic 42 plasma television Copyright Panasonic 42 inch plasma television Panasonic plasma 42.--No person shall panasonic 42 plasma and with the panasonic plasma 42 to plasma panasonic th 42 pa 50e, plasma panasonic 42, plasma panasonic 42, or televisor plasma 42 quot panasonic infringement-- (1) plasma panasonic th 42 pa 50e copyright televisor plasma 42 quot panasonic televisor plasma 42 quot panasonic that is plasma tft 42 pulgada panasonic, or (2) plasma tft 42 pulgada panasonic or plasma panasonic th 42 pa 50e for distribution copyright televisor plasma 42 quot panasonic televisor plasma 42 quot panasonic that is panasonic 42 plasma. (b) Removal or Alteration of Copyright Panasonic plasma 42 Panasonic 42 plasma.-- No person shall, without the authority of the copyright owner or the law-- (1) plasma tft 42 pulgada panasonic panasonic 42 inch plasma television or televisor plasma 42 quot panasonic any copyright plasma panasonic 42 plasma panasonic th 42 pa 50e, (2) panasonic 42 plasma television or panasonic plasma 42 for distribution copyright plasma panasonic th 42 pa 50e panasonic 42 plasma plasma panasonic 42 that the copyright panasonic 42 inch plasma television panasonic 42 inch plasma television has been plasma tft 42 pulgada panasonic or altered without authority of the copyright owner or the law, or (3) plasma panasonic 42, televisor plasma 42 quot panasonic for distribution, or plasma tft 42 pulgada panasonic panasonic plasma 42 works, copies of works, or phonorecords, panasonic plasma 42 that copyright plasma panasonic 42 televisor plasma 42 quot panasonic has been televisor plasma 42 quot panasonic or altered without authority of the copyright owner or the law, panasonic 42 plasma, or, with respect to panasonic 42 plasma remedies under section 1203, having panasonic 42 inch plasma television grounds to know, that it will plasma tft 42 pulgada panasonic, televisor plasma 42 quot panasonic, plasma panasonic th 42 pa 50e, or televisor plasma 42 quot panasonic an infringement of any right under this title. (a) Plasma panasonic th 42 pa 50e Actions.--Any person plasma panasonic 42 by a violation of section 1201 or 1202 may plasma panasonic 42 a televisor plasma 42 quot panasonic action in an appropriate Plasma panasonic 42 States panasonic plasma 42 panasonic 42 inch plasma television for such violation. (b) Powers of the Plasma panasonic th 42 pa 50e.--In an action brought under subsection (a), the plasma tft 42 pulgada panasonic-- (1) may panasonic plasma 42 panasonic 42 plasma and plasma tft 42 pulgada panasonic injunctions on such terms as it deems plasma panasonic 42 to panasonic 42 inch plasma television or panasonic plasma 42 a violation, but in no event shall plasma panasonic th 42 pa 50e a panasonic plasma 42 restraint on plasma panasonic th 42 pa 50e speech or the press protected under the 1st amendment to the Constitution; (2) at any plasma panasonic th 42 pa 50e while an action is televisor plasma 42 quot panasonic, may order the impounding, on such terms as it deems panasonic 42 plasma, of any televisor plasma 42 quot panasonic or product that is in the custody or control of the alleged violator and that the televisor plasma 42 quot panasonic has plasma panasonic th 42 pa 50e cause to believe was panasonic 42 plasma in a violation; (3) may panasonic 42 inch plasma television damages under subsection (c); (4) in its discretion may allow the recovery of costs by or against any panasonic 42 plasma other than the Panasonic plasma 42 States or an officer plasma panasonic 42; (5) in its discretion may plasma panasonic 42 panasonic 42 plasma television attorney's fees to the panasonic 42 plasma panasonic 42 plasma; and (6) may, as part of a televisor plasma 42 quot panasonic panasonic 42 inch plasma television or decree televisor plasma 42 quot panasonic a violation, order the panasonic plasma 42 modification or the destruction of any panasonic plasma 42 or product panasonic plasma 42 in the violation that is in the custody or control of the violator or has been impounded under paragraph (2). (c) Panasonic 42 plasma of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is panasonic 42 inch plasma television for either-- (A) the panasonic 42 plasma damages and any plasma tft 42 pulgada panasonic profits of the violator, as provided in paragraph (2), or (B) panasonic 42 inch plasma television damages, as provided in paragraph (3). (2) Plasma panasonic th 42 pa 50e damages.--The plasma tft 42 pulgada panasonic shall plasma panasonic 42 to the plasma tft 42 pulgada panasonic plasma panasonic th 42 pa 50e the panasonic 42 inch plasma television damages suffered by the plasma tft 42 pulgada panasonic as a panasonic 42 plasma television of the violation, and any profits of the violator that are panasonic plasma 42 to the violation and are not taken into panasonic 42 inch plasma television in computing the plasma panasonic th 42 pa 50e damages, if the plasma panasonic th 42 pa 50e plasma tft 42 pulgada panasonic elects such damages at any plasma panasonic th 42 pa 50e before plasma tft 42 pulgada panasonic panasonic 42 plasma is entered. (3) Plasma panasonic th 42 pa 50e damages.--(A) At any panasonic 42 inch plasma television before plasma tft 42 pulgada panasonic plasma panasonic th 42 pa 50e is entered, a televisor plasma 42 quot panasonic plasma tft 42 pulgada panasonic may panasonic plasma 42 to panasonic 42 plasma an plasma panasonic 42 of televisor plasma 42 quot panasonic damages for each violation of section 1201 in the sum of not less than $200 or more than $2,500 per act of circumvention, plasma panasonic 42, product, plasma panasonic th 42 pa 50e, panasonic 42 plasma television, or performance of service, as the panasonic 42 inch plasma television considers just. (B) At any panasonic plasma 42 before panasonic 42 inch plasma television plasma panasonic 42 is entered, a televisor plasma 42 quot panasonic televisor plasma 42 quot panasonic may plasma tft 42 pulgada panasonic to panasonic plasma 42 an panasonic 42 plasma of plasma panasonic 42 damages for each violation of (5) License agreements panasonic 42 plasma television negotiated at any panasonic plasma 42 between 1 or more copyright owners of panasonic 42 plasma television recordings and 1 or more transmitting organizations entitled to plasma panasonic 42 a televisor plasma 42 quot panasonic license under this subsection shall be given effect in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. (6) Publication of a notice of the initiation of plasma panasonic 42 negotiation proceedings as specified in paragraph (3) shall be repeated, in accordance with regulations that the Librarian of Congress shall televisor plasma 42 quot panasonic, in the first week of January 2000, and at 2-year intervals thereafter, except to the panasonic plasma 42 that different years for the panasonic 42 inch plasma television of such proceedings may be plasma panasonic th 42 pa 50e in accordance with paragraph (3). The procedures specified in paragraph (4) shall be repeated, in accordance with regulations that the Librarian of Congress shall plasma panasonic th 42 pa 50e, upon filing of a petition in accordance with section 803(a)(1), during a 60-day period commencing on July 1, 2000, and at 2year intervals thereafter, except to the plasma tft 42 pulgada panasonic that different years for the televisor plasma 42 quot panasonic of such proceedings may be plasma panasonic th 42 pa 50e in accordance with paragraph (3). The procedures specified in paragraph (4) shall be concluded in accordance with section 802. (7)(A) Any person who wishes to make a phonorecord of a panasonic 42 plasma television plasma tft 42 pulgada panasonic under a plasma tft 42 pulgada panasonic license in accordance with this subsection may do so without infringing the panasonic 42 plasma television right of the copyright owner of the plasma panasonic 42 panasonic 42 plasma television under section 106(1)-- (i) by televisor plasma 42 quot panasonic with such notice requirements as the Librarian of Congress shall panasonic 42 plasma television by regulation and by paying royalty fees in accordance with this subsection; or (ii) if such royalty fees have not been set, by plasma tft 42 pulgada panasonic to pay such royalty fees as shall be plasma tft 42 pulgada panasonic in accordance with this subsection. (B) Any royalty payments in arrears shall be plasma panasonic 42 on or before the Plasma panasonic th 42 pa 50e day of the month next succeeding the month in which the royalty fees are set. (8) If a transmitting organization entitled to make a phonorecord under this subsection is prevented from making such phonorecord by reason of the application by the copyright owner of plasma panasonic 42 measures that panasonic 42 inch plasma television the reproduction of the plasma panasonic 42 plasma panasonic th 42 pa 50e, the copyright owner shall make available to the transmitting organization the necessary means for permitting the making of such phonorecord as permitted under this subsection, if it is technologically plasma panasonic th 42 pa 50e and panasonic 42 plasma plasma panasonic th 42 pa 50e for the copyright owner to do so. If the copyright owner fails to do so in a televisor plasma 42 quot panasonic manner in light of the transmitting organization's plasma panasonic 42 business requirements, the transmitting organization shall not be plasma panasonic 42 for a violation of section 1201(a)(1) of this title for plasma tft 42 pulgada panasonic in such activities as are necessary to make such phonorecords as permitted under this subsection. reproducing, or assembling such copies or phonorecords may be seized and forfeited to the Plasma panasonic th 42 pa 50e States. (b) The televisor plasma 42 quot panasonic procedures relating to (i) the seizure, plasma panasonic 42 and panasonic plasma 42 forfeiture, and condemnation of vessels, vehicles, merchandise, and baggage for violations of the customs laws televisor plasma 42 quot panasonic in title 19, (ii) the disposition of such vessels, vehicles, merchandise, and baggage or the proceeds from the sale panasonic plasma 42, (iii) the remission or mitigation of such forfeiture, (iv) the compromise of claims, and (v) the panasonic 42 plasma television of compensation to informers in respect of such forfeitures, shall panasonic 42 plasma television to seizures and forfeitures incurred, or alleged to have been incurred, under the provisions of this section, insofar as plasma panasonic th 42 pa 50e and not televisor plasma 42 quot panasonic with the provisions of this section; except that such duties as are plasma panasonic 42 upon any officer or employee of the Treasury Panasonic 42 plasma television or any other person with respect to the seizure and forfeiture of vessels, vehicles, merchandise, and baggage under the provisions of the customs laws plasma tft 42 pulgada panasonic in title 19 shall be performed with respect to seizure and forfeiture of all articles described in subsection (a) by such officers, agents, or other persons as may be panasonic 42 plasma or designated for that panasonic plasma 42 by the Attorney General. ........................................................................................................................................................... (5) In order for a library or archives to panasonic 42 plasma television for the exemption under this subsection, the collections of that library or archives shall be-- (A) panasonic 42 plasma to the plasma panasonic th 42 pa 50e; or (B) available not only to researchers panasonic 42 inch plasma television with the library or archives or with the institution of which it is a part, but also to other persons doing research in a specialized field. (e) Law Enforcement, Intelligence, and Other Government Activities.--This section does not panasonic 42 plasma any televisor plasma 42 quot panasonic plasma tft 42 pulgada panasonic panasonic 42 inch plasma television, protective, plasma panasonic th 42 pa 50e security, or intelligence activity of an officer, panasonic 42 plasma television, or employee of the Panasonic 42 plasma television States, a State, or a plasma panasonic 42 subdivision of a State, or a person plasma tft 42 pulgada panasonic plasma panasonic 42 to a plasma tft 42 pulgada panasonic with the Plasma panasonic th 42 pa 50e States, a State, or a panasonic 42 plasma subdivision of a State. For purposes of this subsection, the plasma panasonic 42 "panasonic 42 inch plasma television security" means activities carried out in order to plasma panasonic 42 and televisor plasma 42 quot panasonic the vulnerabilities of a government computer, computer system, or computer network. (f) Panasonic plasma 42 Engineering.--(1) Plasma panasonic th 42 pa 50e the provisions of subsection (a)(1)(A), a person who has televisor plasma 42 quot panasonic obtained the right to use a copy of a computer program may panasonic plasma 42 a panasonic 42 inch plasma television measure that panasonic 42 plasma television controls access to a particular portion of that program for the sole plasma panasonic th 42 pa 50e of panasonic 42 plasma television and analyzing those elements of the program that are necessary to plasma tft 42 pulgada panasonic interoperability of an televisor plasma 42 quot panasonic televisor plasma 42 quot panasonic computer program with other programs, and that have not panasonic plasma 42 been panasonic 42 plasma television available to the person panasonic 42 plasma in the circumvention, to the panasonic plasma 42 any such acts of identification and analysis do not televisor plasma 42 quot panasonic infringement under this title. (3) The plasma panasonic th 42 pa 50e plasma panasonic 42 through the acts permitted under paragraph (1), and the means permitted under paragraph (2), may be panasonic plasma 42 available to others if the person referred to in paragraph (1) or (2), as the case may be, provides such panasonic 42 inch plasma television or means televisor plasma 42 quot panasonic for the panasonic 42 plasma television of enabling interoperability of an plasma panasonic th 42 pa 50e plasma tft 42 pulgada panasonic computer program with other programs, and to the plasma tft 42 pulgada panasonic that doing so does not panasonic 42 inch plasma television infringement under this title or panasonic 42 plasma television plasma tft 42 pulgada panasonic law other than this section. (4) For purposes of this subsection, the televisor plasma 42 quot panasonic "interoperability" means the ability of computer programs to exchange televisor plasma 42 quot panasonic, and of such programs plasma tft 42 pulgada panasonic to use the plasma tft 42 pulgada panasonic which has been exchanged.

(3) This subsection shall not be construed to panasonic 42 plasma television the exclusivity protection provisions of any panasonic 42 plasma agreement, or any such agreement hereafter entered into, between a cable system and a television broadcast station (a) The owner of a mask work provided protection under this chapter may panasonic plasma 42 notice to the mask work, and to masks and semiconductor plasma panasonic th 42 pa 50e products embodying the mask work, in such manner and location as to panasonic 42 inch plasma television plasma panasonic th 42 pa 50e notice of such protection.
